OctexSMS – Terms and Conditions of Service

INTRODUCTION

These General Terms and Conditions ("Agreement" or "Terms") govern the use of the services and platform provided by OctexSMS, operating through https://www.octexsms.com. OctexSMS ("we," "us," "our") is a digital platform that facilitates temporary phone number verifications, rentals, and eSIM services.

Both the Service Provider and Customer ("User(s)," "you," "your") enter into a binding agreement with OctexSMS by using our services or accessing our platform. When users complete transactions on our platform, they also form a direct agreement with each other.

By using our platform and services, you acknowledge and agree to abide by these Terms and any future modifications published on this page. If you do not agree, please discontinue use of our services.

ARTICLE 1. SERVICES

1.1 Services and Platform.

We provide access to a virtual SMS verification and eSIM platform where users can obtain temporary phone numbers or data services from various providers. The full scope of services is outlined on our website and may be updated periodically.

1.2 Ownership.

Unless otherwise stated, OctexSMS retains all intellectual property rights related to the platform and services.

1.3 User-to-User Agreement.

When using services, users may interact directly with external providers via our platform. OctexSMS facilitates the interface but is not liable for third-party outcomes.

1.4 No Warranties.

Services are provided "as is" and "as available." We make no guarantees regarding service continuity, accuracy, or suitability for any particular purpose.

ARTICLE 2. PLATFORM ACCESS AND AUTHORIZED USERS

2.1 Access Rights.

OctexSMS grants users limited, non-transferable access to the platform in accordance with these Terms.

2.2 Platform Ownership.

All contents and functionality remain the exclusive property of OctexSMS, except third-party tools or data.

2.3 No License.

Nothing in this Agreement grants users ownership or licensing rights to OctexSMS's platform or backend software.

2.4 Authorized User.

Each account must be used only by the registered user. Sharing login credentials is prohibited.

2.5 Account Responsibility.

You are responsible for maintaining account security. OctexSMS is not liable for unauthorized access due to lost or shared credentials.

ARTICLE 3. VENDORS

3.1 Vendor Listings.

If you submit services (e.g., numbers from connected APIs), you affirm that you have legal authority to do so.

3.2 Listing Control.

We reserve the right to review and remove vendor listings that violate policies or degrade service quality.

3.3 User Interactions.

OctexSMS does not oversee direct interactions between vendors and users. All transactions are performed at your own risk.

3.4 Order Management.

We reserve the right to cancel or restrict transactions for fraud prevention or service misuse.

ARTICLE 4. FEES, PAYMENTS, AND CHARGES

4.1 Pricing.

Prices for services are listed at https://www.octexsms.com  and are subject to change.

4.2 Fee Changes.

Changes to service pricing will be communicated. Continued use implies acceptance.

4.3 Commissions.

Service charges may include commissions from third-party providers.

4.4 Deposits and Payouts.

All top-ups are credited as platform balance (OC — OctexCoin) and may be subject to minimum deposit amounts or transaction limits.

4.5 Transaction Fees.

Fees may apply to both deposits and service use. Fees from payment gateways (e.g., Paystack, Flutterwave, Cryptomus) may be passed on to the user.

4.6 Taxes.

Users are solely responsible for any applicable taxes in their jurisdictions.

ARTICLE 5. ACCOUNT TERMINATION AND PLATFORM ABUSE

5.1 Platform Abuse.

Misuse of the platform, such as spamming, repeated failed verifications, or bypassing fair use policies, may result in suspension.

5.2 Account Suspension.

We may suspend or terminate accounts without notice for violating platform rules or terms.

5.3 Policy Enforcement.

Continued abuse or attempts to circumvent platform rules will result in permanent ban.

5.4 Fraud Reporting.

Fraudulent activity will be reported to relevant authorities.

5.5 Fair Use Policy.

We reserve the right to limit usage that places unreasonable load on system resources.

5.6 Number Farming.

Bulk testing or repeatedly failing to use numbers correctly may lead to suspension.

5.7 Prohibited Verifications.

Our numbers must not be used for high-risk financial services or any purpose in violation of applicable laws.

ARTICLE 6. DISCLAIMERS AND INDEMNIFICATION

6.1 Disclaimer.

OctexSMS does not guarantee error-free or uninterrupted service. You use the platform at your own risk.

6.2 Indemnity.

You agree to indemnify OctexSMS and its team against any claims, liabilities, or damages arising from your use of the services or violation of these Terms.

ARTICLE 7. GENERAL TERMS

7.1 Legal Capacity.

You confirm that you are legally permitted to use our platform and are not restricted by sanctions or jurisdictional limitations.

7.2 Notices.

Communications will be via email or through your OctexSMS dashboard.

7.3 Severability.

If a term is found invalid, the rest of the Agreement remains in effect.

7.4 No Transfer.

You may not transfer your OctexSMS account without written consent.

7.5 Rejection of Other Terms.

Any terms you introduce (e.g., purchase conditions) are not binding on us.

7.6 Headings.

Headings are for convenience and have no legal effect.

ARTICLE 8. DISPUTE RESOLUTION

8.1 Governing Law.

These Terms are governed by applicable commercial laws and are subject to legal enforcement in any country where OctexSMS operates.

8.2 Dispute Process.

Disputes should first be resolved through informal communication. If unresolved within 14 business days, a neutral mediator may be used.

ARTICLE 9. REFUND POLICY

9.1 Eligibility for Refunds

Refunds may be issued to users who have deposited funds into their OctexSMS account but have not used any portion of the balance for purchasing services (e.g., SMS verifications, number rentals, or eSIMs). A request for a refund must be made within fourteen (14) calendar days from the date of the original deposit. After this period, OctexSMS reserves the right to decline any refund request.

9.2 Conditions for Refund

  • The funds in question must remain unused in your account (i.e., no OC has been spent).
  • You must submit a formal refund request within the 14-day period after the transaction.
  • The refund request must be sent via your OctexSMS account or through an official email to support@octexsms.com  using the email linked to your account.
  • OctexSMS reserves the right to investigate the request and verify that the funds have not been used, misused, or associated with any suspicious activity.

9.3 Refund Processing

Once your request has been reviewed and approved, refunds will be processed using the original payment method used for the deposit. Please allow 5–10 business days for the refunded amount to reflect, depending on your payment provider. Refunds cannot be issued to alternate payment channels for security reasons.

9.4 Refund Denial

Refunds will not be issued in the following scenarios:

  • If any portion of the deposited funds has been used.
  • If the request was made after the 14-day refund window.
  • If the account is flagged for suspicious, abusive, or fraudulent activity.
  • If the services rendered were completed and functioned as intended.

9.5 Chargebacks and Reversals

Users are strictly prohibited from initiating chargebacks or reversing payments via banks, payment processors, or cryptocurrency gateways. In such cases, OctexSMS reserves the right to:

  • Suspend or permanently ban the user's account.
  • Report the incident to relevant authorities or payment gateways.
  • Forfeit any remaining balance in the user's account.

9.6 Refund Request Process

Refunds must be requested by email through support@octexsms.com  using the same email address linked to your account. Please include the amount, payment method used, details for refund processing, and a brief explanation of the reason for the request. OctexSMS will review the request within 5 business days. Refund times may vary depending on third-party processors.

9.7 Refund Processing Method

Refunds will only be processed to the original payment method used. If this is not possible, the user will be offered an alternative refund option. If no preference is given, the refund will be processed using the same method used for deposit.

9.8 Special Circumstances

In rare cases, such as double charges, failed deposits, or verified technical issues, OctexSMS may issue a refund outside the standard conditions. These are reviewed on a case-by-case basis.

ARTICLE 10. SANCTIONS AND COMPLIANCE

10.1 Restricted Jurisdictions.

OctexSMS does not provide services to individuals or businesses in regions restricted by international trade sanctions.

10.2 User Compliance.

You agree to comply with all export restrictions and not to use our services in violation of any law or regulation.

10.3 Investigation Rights.

We reserve the right to investigate, suspend, or terminate accounts suspected of violating compliance terms.

ARTICLE 11. AGE LIMITATIONS

11.1 Age Requirements.

Services are available only to users aged 18 years or older.

11.2 Use by Minors.

If we learn that a user is underage, we will promptly remove the account and associated data.
